NA speaker says opp pioneer arrangement insusceptible to court request

National Assembly Speaker Raja Pervaiz Ashraf has raised objections over the Lahore High Court's (LHC) proceedings probing into the nomination of Raja Riaz as opposition leader in the lower house, citing Article [1] of the Constitution which bars judicial interference in parliamentary matters. The speaker asserted that the proceedings conducted in connection with the declaration are indeed internal proceedings of the parliament and are thus immune from challenge in the courts.

[1]This statement was further supported by the fact that Rule 39 of the Rules of Procedure of the NA, 2007, which was invoked to approve the appointment of Raja Riaz, grants the speaker the power to do so.

[2]Court dissenters have recurred to the argument that what the religion clauses, principally the Establishment Clause, intend to protect is the autonomy of religious institutions and their right to self-governance.

[3]Furthermore, the Constitution also grants the Speaker and Deputy Speaker the right to reference any constitutional questions to the Supreme Court, which is appointed by the Chief Justice from among persons who are qualified to be appointed as Judges of a High Court.
